Abstract
Background and Aim: Gradual ownership is one of the concepts that is widely used in the realm of new agreements and formats such as advance sales contracts. The purpose of this article is to explain gradual ownership in certain contracts in Imami jurisprudence and Iranian law.
Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.
Findings: The findings of the present study show that gradual ownership is envisaged in the form of contracts of sale, lease, and contract of reward; in other words, gradual ownership, despite being common in new forms and within the framework of new needs, has been accepted in the forms of specific jurisprudential contracts.
Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.
Conclusion: The concept of gradual ownership in the field of contracts is not only acceptable in jurisprudential principles, but also aligns with the imperative rules of contract law in Imami jurisprudence, including the necessity of existence; as a result, accepting gradual ownership, whether within the framework of specific contracts or in the form of conditions included in the contract, does not conflict with the approach of Imami jurisprudence.
