Jurisprudential Model of Market Regulation and Economic Vulnerability Reduction within the Framework of Imami Shi‘i Fiqh

Abstract
Background and Aims: This study aims to explain the theoretical foundations and extract the operational mechanisms of market regulation within the framework of Imamiyyah jurisprudence, while proposing a structural model to reduce economic vulnerability.
Materials and Methods: This research adopts a descriptive-analytical approach. The data are qualitative and were collected through note-taking (library research).
Ethical Considerations: In this paper, the authenticity of the texts, integrity, and honesty in citation have been strictly observed.
Findings: The findings indicate that the Imamiyyah jurisprudential model possesses a nature of “market-oriented with expert-based supervision.” This means that under normal conditions, it is based on the principle of dominion (Sultanah), freedom of contract, and the presumption of validity (Asalat al-Sahhah).. These findings were derived from an interpretive jurisprudential analysis of Imami (Shiʿi) legal sources—including the Qur’an, Sunnah, and the opinions of jurists—through which the general principles governing transactions were extracted. They were then examined using a functional–institutional analysis to compare how these principles regulate the market under both normal and crisis conditions.
Conclusion: Such intervention can be realized through expanding the scope of hoarding (Ihtikar) to include essential commodities, permitting price-fixing (Tas’ir) under conditions of exploitation, revitalizing the institution of Hisbah within modern regulatory structures, countering monopolies, and ensuring balance in adhesion and electronic contracts.
