Abstract

Background and Aims: The aim of this article is to compare the fundamental principles of justice implementation related to the rights of children and adolescents in the process of criminal proceedings in Iran's legal system with international documents.

Materials and methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.

Ethical considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.

Findings: The fundamental principles of the implementation of justice related to the rights of children and adolescents in the preliminary investigation process include the principle of prohibition of arbitrary arrest of para-judicial institutions and in the criminal proceedings stage including fair light of The establishment of a special court for children, the principle of participation in criminal proceedings, the principle of participation in criminal proceedings and the principle of individualizing punishments and filing personality files have been recognized both in Iranian criminal law and in international documents including the standard rules of juvenile proceedings approved in 1985 known as the Beijing Rules and the Convention on the Rights of the Child approved in 1989.

Result: Although in Iranian criminal law, like international documents, under the influence of fair proceedings, institutions such as the police, special prosecutor's office, specialized court for children and ju and juveniles and the correctional center have been formed.
