Abstract
Background and Aims: The purpose of this article is to examine the approach of Iranian criminal law and European Union law in dealing with drug and psychotropic drug trafficking.
Materials and Methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used to collect materials and data.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings: The establishment of new laws of criminal procedure and Islamic punishment in 1392 and the addition of Article 45 to the anti-narcotics law in 1396 by the parliament has largely provided the ground for the implementation of the government's international obligations regarding international procedural standards. Nevertheless, the application of the death penalty in crimes related to drugs and psychotropic substances is criticized by some domestic jurists and international institutions. The 2013-2020 strategy of the European Union in the field of narcotics revolves around two main axes, i.e. reducing the demand for narcotics and reducing the supply of narcotics, and in this context, it follows three main approaches, i.e. coordination, international cooperation and information, research, monitoring and evaluation.
Conclusion: It is necessary for the legislator to implement the international obligations of the government in the field of effective fight against narcotics and psychotropic substances, while paying attention to the requirements of human rights, by enacting laws that are in line with the aforementioned international treaties or by repealing laws that are contrary to them.
