Abstract
Background and purpose: Every emerging phenomenon must be measured by legal and shari'a criteria before it is affected by the members of the society. Therefore, researching and scrutinizing the concept of money, in order to make such emerging activities transparent, is the goal of this research.
Materials and Methods: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and was done by referring to documents, books and articles.
Ethical Considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.
Results: The emergence of new examples of sale requires that the laws be reviewed in accordance with jurisprudential texts.
Conclusion: In order to prove the generalization of sale to non-gentlemen, the explanation of the transaction in Articles 214 and 338 of the Civil Code is ambiguous, therefore, since any asset, including property, benefit and right, can be bought and sold, This research considers the definitions provided in the mentioned materials incomplete.
