Abstract
Abstract Background and aim: The purpose of this analysis is to identify the strengths and weaknesses of Iran's legal system and Islamic jurisprudence in order to help create a coherent and efficient framework in order to protect consumers and promote justice in transactions. Methods: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and was done by referring to documents, books and articles. Ethical considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected. Results: In both Iranian legal systems and Islamic jurisprudence, issues such as knowledge of the defect, acceptance of the defect, and the time of application of the cucumber are among the important factors in the fall of the right of the cucumber. Also, both systems emphasize the necessity of good faith and good behavior in contracts and believe that incorrect information or non-disclosure of defects can lead to deprivation of cucumber rights. However, in Iranian law and Islamic jurisprudence, there are differences in the details and how to understand the defects and muscats of cucumbers; For example, in Islamic jurisprudence, the range of opinions of jurists regarding the analysis of defects and the way of compensation may be more diverse. Conclusion:. Scrutiny in the concepts of cucumber defect and its consequences indicates the need to pay attention to good faith and ethics in transactions, which are among the distinctive features of Islamic societies.
