Abstract
Background and Aims: Today, there are many methods of payment of price and value in the oil industry based on the type of contract, which are named according to the same method of payment of the contract; such as Buy Back, Swap, BOT, Joint Venture, and service-only contracts, joint investment in oil futures, and participation in production. We will discuss the legal methods of payment of price and value in oil contracts.
Materials and Methods: This research is theoretical and the research method is descriptive-analytical, and the method of collecting information is library-based and was carried out by referring to documents, books, and articles.
Ethical Considerations: In the present research, the principles of trustworthiness, honesty, impartiality, and originality of the work have been observed.
Findings: In the oil industry, methods of payment of price and value are examined through the conclusion of numerous contracts in the fields of exploration, exploitation, and refining, production, sales, technology, purchase and management, transportation, and ... Also, the compliance of the payment of the price and the estimated value of these contracts with the legal foundations and laws governing Iran is of particular importance in terms of the newness and modernity of this industry.
Conclusion: From a legal perspective, it should be in accordance with various legal articles and clause b of Article 214 of the Fifth Development Plan Law as well as the Foreign Investment Protection Law approved by the Islamic Consultative Assembly and the legitimacy of fulfilling promises and obligations and types of contracts, including rental, lease, etc.
