Abstract
Background and Aim: Nowadays, attracting foreign investors is an inevitable necessity and choosing arbitration as the most common and most appropriate method to resolve investment disputes is one of the most important components for the development of international investment. The European Union, as one of the most successful experiences in the convergence of international relations, has provided several developments in the relations between its members, one of which is the Treaty of Lisbon.
Materials and Methods: This article is done in a descriptive-analytical way, using library resources and with a phishing tool.
Ethical Considerations: In this article, the authenticity of the texts, honesty and trustworthiness have been observed.
Findings: According to the Treaty of Lisbon, EU member states are required to match the obligations arising from the mutual support and encouragement agreements of the investor with the requirements of that treaty, but the arbitration authorities implement the provisions of the investment agreement.
Conclusion: It is debatable whether the arbitral tribunals should finally apply the EU law or the obligations based on international law are preferable, but what becomes important in dealing with disputes is the will of the parties to implement the arbitration awards.
