Legal Basis of Maritime Damage in Iranian and English Law and Comparison with Similar International Institutions

Abstract
Background and purpose: Maritime joint damage is an important issue in maritime law, the study of which is of great importance and necessity.. Accordingly, the aim of the present article is to study the legal foundations of maritime damage in Iranian and English law and compare it with similar international institutions.
Materials and Methods: The present article is descriptive and analytical. The materials and data are also qualitative, and questionnaires were used to collect the materials and data.
Ethical Considerations: In this article, the originality of the texts, honesty, and trustworthiness have been observed.
Findings: The theory of justice and gratuitous possession, the theory of contract, and the theory of agency are among the most important foundations of maritime joint damage. It is an indefinite legal act that has been determined and established in order to meet human needs for the a specific and indefinite legal act according to which, upon fulfillment of the necessary conditions, the liability of the interested parties in a maritime voyage to compensate the injured party based on the joint damage institution is automatically realized, provided that the interested parties have not concluded an agreement to the contrary.
Conclusion: The conclusion is that joint damage of maritime civil liability is similar and overlaps with the contract of carriage and the conventions governing the contract of carriage, with the contract of carriage in the Hague-Visby Convention and maritime assistance and salvage.
