Jurisprudential and Legal Arguments for Claiming Damages from Public Institutions With an Emphasis on Economic Damages

Abstract
Background and purpose: Due to their role and activities in society, public institutions carry out activities that may cause damage to citizens in some cases. Therefore, finding jurisprudential and legal reasons for claiming economic damages from these institutions is very important, which is addressed in this research.
Materials and Methods: The method of this article is analytical and descriptive, and the research tool is library.
Ethical Considerations: Documentary referencing and trustworthiness are the basis for writing this article.
Findings: If the activities of public institutions cause damage to citizens, jurisprudential rules such as the sanctity of Muslim property, the prohibition of encroachment on citizens' property and assets, the jurisprudential rule of attribution and the consideration of the rakban can be considered reasons for claiming damages from these institutions. Legal reasons arising from these jurisprudential rules are considered to be the responsibility of public institutions in the event of causing damage to citizens.
Conclusion: If public institutions carry out development and service activities without considering the assets and property of citizens and with the sole aim of expropriating and dispossessing private owners of their goods, properties, and sometimes their property interests, they cause damage and loss to their assets and properties, for which they can claim compensation according to Article 40 of the Constitution.
