Abstract
Background and Aims: Today, the diversity of contracting contracts due to the interdisciplinary nature of contracting has created problems in regulating working relationships for employers and contractors. In this regard, the purpose of the current research is to examine the legal nature of EPC+F contracting contracts.
Materials and Methods: The method of this article is analytical and descriptive and the research tool is library.
Ethical Considerations: in the writing of this article, documentary referencing and trustworthiness are the basis.
Findings: Contracts for construction and design of equipment known as EPC+F, which are contracts with financing, have created ambiguities for lawyers from the point of view of nature. Since the domestic contractors are facing problems in the implementation of the mentioned contracts due to various reasons such as project volume, price fluctuations and lack of investors in the financial sector, in some cases the implementation and financing section has been removed from the contract and the design and purchase model (EP) ) is considered.
Conclusion: The nature of EPC+F contracts has also created challenges in compliance with definite or indefinite contracts, and according to the use of these contracts in oil contracts and comparing these contracts with definite contracts, these contracts seem indefinite. have and are subject to Article 10 of the Civil Law and contractual agreements relatively.
