Abstract
Background and purpose: The implementation procedures of environmental rights in the prevention of pollution and the use of economic tools for its protection are the subject of discussion in Iran. The purpose of the article is to examine some of these procedures, the use of economic tools and the application of protective rules.
Materials and Methods: Descriptive analytical method was used in the research, and library and survey sources were used.
Ethical Considerations: The authenticity of the text, honesty and trustworthiness have been observed.
Findings : In Iran, there are appropriate laws, the problematic issue is the lack of compliance with environmental regulations, especially by the government and transnational companies, the lack of proper and legal infrastructures, etc., he pointed out. If these legal infrastructures are codified in appropriate ways, they are able to produce effective results. The principles in the constitution are the responsibility of all members of the society in order for the current and future generations to go through a growing collective life. Therefore, the actions taken in the economic, social and cultural fields that cause pollution will be illegal.
Result: Pollution of the environment and neglecting its ability to revive has created various problems in order to support, international law has created rules for protection in the domestic and global dimension. Examining the existing rules in Iran is a legal measure in the application of new procedures. The Constitution and other laws consider the protection of this area to be everyone's duty, one can see shortcomings such as assessing the effects of losses, methods of compensation, using economic tools, etc.
