The Validity of Privacy in Commercial Transactions from the Perspective of Islamic Jurisprudence

Abstract
Background and Purpose: The issue of respect for privacy in commercial transactions is of particular importance from the perspective of Islamic jurisprudence, because privacy is not only a moral principle but also one of the fundamental pillars of justice and fairness in business. Islamic jurisprudence has always emphasized the protection of the honor and rights of others, and in the context of transactions, respecting the privacy of individuals is considered a religious and social responsibility. The current research has been carried out with the aim of investigating the characteristics of privacy from the perspective of Islam in jurisprudence, with an emphasis on the validity and respect of privacy in business transactions.
Methods: This research is of a theoretical type and has been carried out using a descriptive-analytical method.
Ethical Considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.
Results: Laws and regulations that can be enacted in Iran should be approved with an Islamic approach and with the limits of non-coercive and non-repressive supervision of the ruling power along with a guarantee of appropriate implementation.
Conclusion: Harim ruling is different in the new theory and the famous theory, and in fact, the mandatory ruling and the status ruling of Harim are easily interpreted on the basis of the harm that is the contrary opinion, while according to the famous theory, only the mandatory ruling of Harim is justified. Accepted in the sense that when someone violated another's sacred space, according to the famous theory, only a forbidden act was committed, but according to the second theory, in addition to that, the aggressor must also compensate the damage caused.
