Abstract
Background and Aim: The purpose of this article is to examine the legal disputes between the employer and the contractor; It is the General Department of Roads and Urban Development of Kohgiluyeh and Boyer Ahmad Province.
Materials and Methods: The method of work is in the field and in the form of content analysis.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings: The findings showed that falsification in contracts by the employer, non-compliance with the provisions of Article 37 of the general conditions of the contract, delay by the employer in paying claims and delay and deduction by the contractor under the pretext of sleep and stoppage of the workshop machinery are among the most important disputes between the employer .
Conclusion: The result is that the permitted and unauthorized delay in the general conditions of the contract are related to the time specified in the contract period, which is the responsibility of the consulting engineer and his agreement with the contractor and its approval with the employer. There is no specific rule and criteria for identifying the employer's unauthorized delays in fulfilling financial obligations in the contract, and this issue has resulted in the issuing of judgments against the General Administration of Roads and Urban Development for the payment of delay damages.
