Abstract
Background and aims: prevention of banking crimes is of great importance due to the occurrence of the most important economic crimes in the banking sector. Based on this, the purpose of this article is to examine the approach of Iranian law and international documents in fighting banking system crimes.
Materials and Methods: The current research is applied in terms of type and purpose, and descriptive in terms of nature and method, and data collection has been done through document review and extracting from domestic sources and international documents.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are respected.
Findings: The general policy of the legislator in banking crimes is to intensify the punishment and reduce the powers of judges in mitigating, converting or suspending the punishment. The approval of international and regional conventions and documents such as the International Convention against Corruption, known as the Merida Convention, is one of the efforts at the international level to fight military banking crimes. Decisive legal and penal treatment of criminals is the first and most important solution to combat banking crimes, which the judicial system must follow seriously. Also, the implementation of research projects in order to find the root causes of banking crimes from a judicial perspective and to find appropriate solutions to deal with them is one of the most important duties of the judiciary in order to prevent economic corruption.
Result: Amending and revising the existing laws based on the needs of the society and increasing the weight of criminal measures will reduce banking crimes.
