Abstract
Background and Aims: Property security is one of the important issues and the basis of economic development. Based on this, the aim of this article is a comparative study and economic analysis of the level of ownership guarantee in Iran based on the international index of property rights.
Materials and methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings: The findings showed that in the country's legal system, the parties to contracts and transactions prefer normal transfer due to the costs related to official and improper performance guarantee. Registration of transactions can be of and operate based on efficiency criteria if, firstly, the guarantee of ownership resulting from registration is done in a complete way, and secondly, legal conflicts and ambiguities are resolved, and there is a guarantee of proper execution for non-registration of transactions subject to mandatory registration. Be considered.
Result: The result is that in such a situation, making registration mandatory along with the guarantee of effective legal enforcement, which is one of the requirements of the country's property rights system, has improved the regional and global rank of ownership in Iran by removing the shortcomings and ensuring and stabilizing the maximum of property rights in the country. will accompany.
