Abstract
Background and Purpose: The production and supply of unlimited data and information in the Internet space has caused the demand for data storage and processing to increase. This has made the discussion of responsibility in cloud computing contracts an important issue. In this regard, the purpose of this article is to examine the responsibility in cloud computing contracts.
Materials and Methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings: The findings showed that cloud service providers, regarding the issue of cloud contracts, are responsible for maintaining customer data in cases of 1. Damages caused by negligence 2. Damages caused by breach of foreseeable contractual obligations 3. Intentional damages have responsibility In fact, this obligation is as long as the data breach is not caused by external factors.
Result: The legislator should clearly prohibit the issue of disclaimer of responsibility regarding intentional damage or damage caused by violation and excess. In the end, assuming the fault of the damage and the responsibility of the service provider, we arrived at one of the common compensation mechanisms in the cloud industry called credit services; Although it is mentioned in cloud contracts as a way to protect the interests of customers, it seems that this system is actually an obstacle for claiming damages or termination by customers.
