Abstract
Background and Aims: The responsibility of the air freight broker is one of the important issues that needs to be discussed and investigated due to the high volume of air cargo transportation .The purpose of this article is to examine the basis and limits of the responsibility of the air freight broker according to the various provisions of the civil law and trade law and international conventions.
Materials and Methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.
Ethical Considerations: In this article, the originality of the texts, honesty and trustworthiness are respected.
Findings: In Iran's commercial law, due to the fact that at the time of its approval, there was no shipping agent in today's sense, there are no specific provisions for shipping agents. However, in the last few decades in the field of transportation industry, air transport operators have been divided into two categories, carriers and forwarders, whose Persian equivalent is transport broker.
Conclusion: On the other hand, air freight brokers or forwarders design how to carry goods by air on behalf of the owner of the goods, and without being the owner of the means of air transportation, they issue a transport contract and bill of lading with the owner and shipper of the goods, and then deliver the goods. He directs the air transportation program to the carrier of the aircraft owner, and after the goods arrive at the destination, after receiving the goods from the airline company of the aircraft owner, he clears the goods and delivers them to the recipient.
