In contrast, the European Union employs a technocratic and operational paradigm, prioritizing situational prevention and the technical standardization of banking infrastructures.<br /> Conclusion: The study concludes that the misalignment and lack of coherence between these global and regional frameworks have fostered regulatory lacunae and the proliferation of &quot;cyber havens.&quot; Perpetrators leverage such discrepancies to sustain their illicit operations, thereby highlighting the urgent imperative for a transition toward a convergent and integrated global strategy. زمینه و هدف: پژوهش حاضر با هدف تحلیل جرم‌شناختی جرائم سایبری بانکی (نظیر باج‌افزارها و حملات هوش مصنوعی) و بررسی تطبیقی رویکردهای سازمان ملل متحد و اتحادیه اروپا در مواجهه با این تهدیدات، از منظر مؤلفه‌های علت‌شناسی و پیشگیری انجام شده است.<br /> مواد و روش‌ها: این تحقیق از نوع نظری بوده و با ‌روش توصیفی-تحلیلی و ابزار کتابخانه‌ای گردآوری شده است.<br /> ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت‌داری رعایت شده است.<br /> یافته‌ها: بررسی‌ها نشان می‌دهد سازمان ملل بر رویکرد هنجارساز و پیشگیری اجتماعی (کاهش شکاف دیجیتال و تقویت ظرفیت‌ها) تمرکز دارد، در حالی که اتحادیه اروپا رویکردی تکنوکراتیک و عملیاتی با تأکید بر پیشگیری وضعی و استانداردسازی فنی زیرساخت‌ها را اتخاذ کرده است.<br /> نتیجه: نتایج تحقیق حاکی از آن است که فقدان همسویی و ناهماهنگی میان این دو رویکرد (جهانی و منطقه‌ای)، منجر به ایجاد خلأهای نظارتی و شکل‌گیری پناهگاه‌های سایبری شده است که بزهکاران از این عدم تطابق برای تداوم فعالیت‌های مجرمانه خود بهره می‌برند و این امر، ضرورت گذار به سوی یک راهبرد جهانی هم‌گرا و یکپارچه را بیش از پیش آشکار می‌سازد.
