The materials and data are qualitative and data collection was used to collect the materials. <strong>Ethical Considerations</strong><strong>:</strong> The originality of the texts, honesty and trustworthiness have been made. <strong>Findings</strong><strong>:</strong> From the point of view of jurisprudence and religious principles, the preservation of the environment and natural resources has been raised as a moral and religious duty, and the responsibility of the people and the government has been emphasized in this regard. From a legal point of view, the rights of future generations are recognized as a human right, and the people and the government are obliged to create and comply with environmental protection policies and laws and their implementation. <strong>Conclusion</strong><strong>:</strong> From the point of view of each jurisprudential and legal point of view, the people and the government have special responsibilities in the preservation and sustainable management of natural resources and environmental protection. Therefore, special importance has been given to measures that preserve biodiversity, reduce pollution, sustainable management of natural resources, and implement effective policies to guarantee the rights of future generations to use the environment. <strong>زمینه و هدف</strong><strong>:</strong> حفظ حقوق نسل‌های آینده در بهره‌برداری از محیط‌زیست از منظر فقهی و حقوقی، بر پایه اصول دینی، اخلاقی و حقوق همواره مورد تأکید بوده است و هدف از آن، تعهدات مسئولانه و تأمین حقوق نسل‌های آینده برای بهره‌مندی از محیط‌زیست سالم و پایدار است که در مقاله حاضر نیز مورد تحلیل قرار گرفت. <strong>مواد و روش</strong><strong>­ ها</strong><strong>:</strong> این مقاله از نوع توصیفی تحلیلی است. مواد و داده‌ها کیفی است و از فیش‌برداری در گردآوری مطالب استفاده‌ شد. <strong>ملاحظات اخلاقی</strong><strong>:</strong> در نگارش مقاله، اصالت متون، صداقت و امانت­داری شده است. <strong>یافته‌ها</strong><strong>:</strong> از دیدگاه فقه و اصول دینی، حفظ محیط‌زیست و منابع طبیعی به‌عنوان تکلیف اخلاقی و دینی مطرح‌ شده است و بر مسئولیت مردم و دولت در این زمینه تأکید شده است. از دیدگاه حقوقی، حقوق نسل‌های آینده به‌عنوان یک حق انسانی مورد شناخت قرار گرفته است و مردم و دولت موظف به ایجاد و رعایت سیاست‌ها و قوانین حفاظت از محیط‌زیست و اجرای آن‌ها هستند. <strong>نتیجه</strong><strong>:</strong> از منظر هر یک از دیدگاه‌های فقهی و حقوقی، مردم و دولت مسئولیت‌های خاصی در حفظ و مدیریت پایدار منابع طبیعی و حفاظت از محیط‌زیست دارند. ازاین‌رو، اهمیت ویژه‌ای به اقداماتی داده شده است که به حفظ تنوع زیستی، کاهش آلودگی، مدیریت پایدار منابع طبیعی و اجرای سیاست‌های مؤثر برای تضمین حقوق نسل‌های آینده در بهره‌برداری از محیط‌زیست، توجه دارد. https://journal.ihrci.ir/article_195140_fa371e8c4b67416bef79f52812771628.pdf
