In this article, an attempt has been made to examine the impact of changes in business contracts from the point of view of jurisprudence and judicial procedure.Materials and methods: The article is descriptive and analytical, using the library method. Findings: In Islamic jurisprudence, the rule of negation of distress and constriction and the rule of prohibition of detriment and the loss occurring in the contract could be the foundation for accepting the change of circumstances in commercial contracts. The impact of changing circumstances on commercial contracts in Iranian law is not legally clear, but it has not been rejected. In the judicial procedure, a few opinions could be found that accept the impact of changing circumstances in commercial contracts, despite the legal vacuum in this field.Conclusion: It seems that in the silence of the legislator, it is possible to modify the contracts by referring to the rule of negation of distress and constriction and the rule of prohibition of detriment and the loss occurring in the contract, and the legal system can be moved to the direction of judicial modification of contracts. However, considering the economic changes and developments that affect commercial contracts, it is necessary for the legislator to accept the impact of changing circumstances on commercial contracts in the form of legal articles.}, keywords = {Change of Circumstances,commercial contracts,Negation of Distress and Constriction Rule,Prohibition of Detriment Rule,adjustment of the contract}, title_fa = {تاثیر تغییر اوضاع و احوال در قراردادهای تجاری از منظر فقه و رویه قضایی}, abstract_fa = {زمینه و هدف: یکی از معاذیری که به عنوان استثناء بر اصل لزوم یا الزامی بودن قراردادها به شمار می‌آید، تغییر اوضاع و احوال قرارداد است. در این مقاله تلاش شده به بررسی تاثیر تغییر اوضاع و احوال در قراردادهای تجاری از منظر فقه و رویه قضایی پرداخته شود.مواد و روش‌ها: مقاله توصیفی تحلیلی بوده و از روش کتابخانه‌ای استفاده شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: در فقه اسلام، قاعده نفی عسر و حرج و قاعده لاضرر و غبن حادث، می‌تواند مبنای پذیرش تغییر اوضاع و احوال در قراردادهای تجاری قرار گیرد. تاثیر تغییر اوضاع و احوال بر قراردادهای تجاری در حقوق ایران صراحت قانونی ندارد، اما رد نشده است. در رویه قضایی نیز می‌توان به معدود آرائی دست یافت که علیرغم خلاء قانونی در این زمینه، تاثیر تغییر اوضاع و احوال در قراردادهای تجاری را پذیرفته و در مواردی نیز به رد تعدیل قرارداد رای داده است.نتیجه‌گیری: به نظر می‌رسد در سکوت قانونگذار می‌توان با استناد به قواعد نفی عسر و حرج، قاعده لاضرر و غین حادث نسبت به تعدیل قراردادها اقدام نمود و نظام حقوقی به سمتی سوق داد که نسبت به تعدیل قضایی قراردادها اقدام شود. با این حال با توجه به تغییرو تحولات اقتصادی که قراردادهای تجاری را تحت تاثیر قرار می‌دهد لازم است قانون‌گدار در این خصوص نسبت پذیرش تاثیر تغییر اوضاع و احوال بر قراردادهای تجاری در قالب مواد قانونی گام بردارد.}, keywords_fa = {تغییر اوضاع و احوال,قراردادهای تجاری,قاعده نفی عسر و حرج,قاعده لاضرر,تعدیل قرارداد}, url = {https://journal.ihrci.ir/article_157672.html}, eprint = {https://journal.ihrci.ir/article_157672_8b2fe6d3a1db012bab9b381939408f3a.pdf} }
