In the present article, an attempt has been made to discuss various modifications on the subject matter of civil litigation and the rules governing it.Findings: Various legal methods of modifying the subject matter of claim, including increasing the claim, reducing the claim and changing the claim, are provided in Article 98 of the Civil Procedure Code. Conclusion: Increasing demand means increasing the amount of demand and entails a quantitative growth of the claim while decreasing demand is its opposite. Changing a demand means replacing a new demand instead of the damand inserted in the petition. If the increase or change of the demand is outside the prescribed deadline or does not meet the condition of unity of origin and connection with the original demand, will not be admissible by the court. Triple modifications on demand will affect the scope of the court proceedings and will also affect the ability to review or appeal. In addition, an increase in the claim will inevitably lead to an increase in the cost of the proceedings and a change in the claim may have such an effect according to the case.}, keywords = {Subject of Litigation,Demand for Relief,Principle of Litigation Stability,Increase of Demand,Decrease of Demand,Change of Demand}, title_fa = {دخل و تصرف در موضوع (خواسته) دعوای مدنی}, abstract_fa = {زمینه و هدف: اصل ثبات عناصر دعوا اقتضا دارد که حتی الامکان ارکان دعوا ثابت بمانند و تغییرات احتمالی نیز بایستی در چارچوب مقررات صورت پذیرد. در مقاله حاضر سعی بر این است تا انحاء مختلف دخل و تصرف در موضوع دعوای مدنی و ضوابط حاکم بر آن به بحث گذاشته شود. یافته‌ها: شیوه‌های قانونی دخل و تصرف در موضوع دعوا مشتمل بر افزایش خواسته، کاهش خواسته و تغییر خواسته در ماده 98 قانون آیین دادرسی مدنی پیش بینی شده است. از آنجا که ارکان دعوا بایستی تا پایان اولین جلسه دادرسی تثبیت شوند، افزایش یا تغییر خواسته تا پایان جلسه اول دادرسی امکانپذیر است لیکن کاهش خواسته به لحاظ تأثیر ارفاقی نسبت به خوانده، با محدودیت زمانی پیش‌گفته مواجه نمی باشد. نتیجه‌گیری: افزایش خواسته به معنای افزودن بر میزان خواسته و متضمن رشد کمّی خواسته بوده و کاهش خواسته نقطه مقابل آنست. تغییر خواسته نیز به معنای جایگزینی خواسته جدید به جای خواسته مطروحه در دادخواست تلقی می گردد. چنانچه افزایش یا تغییر خواسته خارج از مهلت مطرح شده یا شرط وحدت منشأ و ارتباط با خواسته اولیه را نداشته باشد، قابل ترتیب اثر از سوی دادگاه نخواهد بود. تصرفات سه‌گانه در خواسته دعوا بر محدوده رسیدگی دادگاه مؤثر واقع شده و بر قابلیت تجدیدنظر و فرجام رأی نیز تأثیرگذار خواهند بود. به علاوه، افزایش یا تغییر خواسته لزوما یا برحسب مورد در تعیین میزان هزینه دادرسی نیز تأثیر می گذارد.}, keywords_fa = {موضوع دعوا,خواسته,اصل ثبات عناصر دعوا,افزایش خواسته,کاهش خواسته,تغییر خواسته}, url = {https://journal.ihrci.ir/article_147643.html}, eprint = {https://journal.ihrci.ir/article_147643_20a08968d91934d34e8b48d2960e2d43.pdf} }
