Journal Article 2025 06 26 <strong><span>Background and </span></strong><strong><span>Aims</span></strong><span>: </span><span>Privacy in the workplace from the perspective of law and jurisprudence is a sensitive and important issue due to the challenges between the rights of workers and employers. On the one hand, employees provide their employers with a lot of private information for employment and during work, and on the other hand, employers need to monitor and collect information to protect their economic interests and workplace security. The purpose of this study is to provide a comprehensive legal and jurisprudential framework to balance these mutual rights.</span> <span> </span> <span> </span> <strong><span>Materials and Methods</span></strong><strong><span dir="RTL" lang="FA">:</span></strong><span lang="FA"> </span><span>This research is of a theoretical type and has been carried out using a descriptive-analytical method.</span> <strong><span dir="RTL" lang="FA"> </span></strong> <span> </span> <strong><span>Ethical Considerations</span></strong><span>: </span><span>In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.</span> <span> </span> <strong><span>Findings</span></strong><strong><span>:</span></strong><span> From a legal perspective, although there are no specific and codified laws in Iran, the Privacy Protection Bill has attempted to establish frameworks for electronic surveillance.</span> <span> </span> <strong><span>Conclusion</span></strong><strong><span>:</span></strong><span> It seems necessary to develop a comprehensive and transparent law that defines the boundaries of modern surveillance, especially in the field of information technologies. This law should be inspired by the jurisprudential and ethical foundations of Islam and, taking into account the developments of the information age, seek to create a healthy, safe and trust-filled work environment.</span> <strong><span lang="FA">زمینه و هدف:</span></strong><strong><span lang="FA"> </span></strong><span lang="FA">حریم خصوصی در محیط کار از منظر حقوق و فقه، به دلیل وجود چالش‌های میان حقوق کارگران و کارفرمایان، موضوعی حساس و مهم است. از یک طرف، کارکنان برای استخدام و در طول کار، اطلاعات خصوصی بسیاری را در اختیار کارفرما قرار می‌دهند و از طرف دیگر، کارفرمایان برای حفظ منافع اقتصادی و امنیت محیط کار، نیازمند نظارت و جمع‌آوری اطلاعات هستند. هدف از این بررسی، ارائه یک چارچوب جامع حقوقی و فقهی برای تعادل بخشیدن به این حقوق متقابل است.</span> <strong><span lang="FA">مواد و روش­ها: </span></strong><span lang="FA">این تحقیق از نوع نظری بوده و به روش توصیفی </span><span lang="FA">–</span><span lang="FA"> تحلیلی صورت گرفته است.</span> <strong><span lang="FA">ملاحظات اخلاقی:</span></strong><span lang="FA"> </span><span lang="FA">در تحقیق حاضر، اصل امانتداری، صداقت، بی­طرفی و اصالت اثر رعایت شده است.</span> <strong><span lang="AR-SA">یافته ­ها:</span></strong><span lang="AR-SA"> </span><span lang="AR-SA">از منظر حقوقی، هرچند قوانین خاص و مدونی در ایران وجود ندارد، اما لایحه حمایت از حریم خصوصی تلاش کرده تا چارچوب‌هایی را برای نظارت‌های الکترونیکی وضع کند. </span> <strong><span lang="AR-SA">نتیجه:</span></strong><span lang="AR-SA"> تدوین یک قانون جامع و شفاف که مرزهای نظارت‌های نوین، به ویژه در زمینه فناوری‌های اطلاعاتی، را مشخص کند، ضروری به نظر می‌رسد. این قانون باید با الهام از مبانی فقهی و اخلاقی اسلام و با در نظر گرفتن تحولات عصر اطلاعات، به دنبال ایجاد یک محیط کاری سالم، امن و سرشار از اعتماد باشد</span><span dir="LTR">.</span> https://journal.ihrci.ir/article_244059_0131a886af4e9623e168c511721ba873.pdf
