The centrality of these dimensions and ambiguities are the limits of this ownership and its effects. The limits of ownership of the frontier space can be analyzed from different dimensions, and this article examines this issue from the angles of ownership of the frontier space, the territory of the frontier space, the limitations of the rights related to the frontier space.</span> <strong><span>Materials and Methods</span></strong><span>: This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and was done by referring to documents, books and articles.</span> <strong><span>Ethical Considerations</span></strong><span>: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been respected.</span> <strong><span>Findings</span></strong><span>: The content of the property right on the border area has some differences with the frameworks of the owner's right. These differences are not only limited to restrictions on ownership.</span> <strong><span>Conclusion</span></strong><span>: A uniform approach has not been adopted in relation to the border area. Therefore, it can be seen that the restrictions of possessions are not only in the field of construction, but also in the field of using the adjacent space.</span> <strong><span lang="FA">زمینه و هدف:</span></strong><span lang="FA"> </span><span lang="FA">آنچه تحت عنوان مالکیت بر فضای بالا و پایین سطح زمین در قوانین مختلف مطرح شده است در عین حال که لازمه بهره‌مندی از زمین می‌باشد، اما دارای ابعاد و ابهامات متنوعی نیز می‌باشد. محوریت این ابعاد و ابهامات حدود این مالکیت و آثار آن می‌باشد. حدود مالکیت بر فضای محاذی از ابعاد مختلفی قابل تحلیل است که این نوشتار، این موضوع را از زوایای خصوصیات مالکیت بر فضای محاذی، قلمروی فضای محاذی، محدودیت‌های حقوق مرتبط با فضای محاذی مورد بررسی قرار می</span><span lang="FA">‌</span><span lang="FA">دهد.</span> <span dir="LTR"> </span> <strong><span lang="FA">مواد و روش­ها:</span></strong><span lang="FA"> </span><span lang="FA">این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی </span><span lang="FA">–</span><span lang="FA"> تحلیلی است و روش جمع</span><span lang="FA">‌</span><span lang="FA">آوری اطلاعات به صورت کتابخانه</span><span lang="FA">‌</span><span lang="FA">ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span> <span lang="FA"> </span> <strong><span lang="FA">ملاحظات اخلاقی:</span></strong><span lang="FA"> </span><span lang="FA">در تحقیق حاضر، اصل امانتداری، صداقت، بی</span><span lang="FA">‌</span><span lang="FA">طرفی و اصالت اثر رعایت شده است.</span> <span lang="FA"> </span> <strong><span lang="FA">یافته­ها:</span></strong><span lang="FA"> </span><span lang="FA">محتوای حق مالکیت بر فضای محاذی از جهاتی با چارچوب های حق مالک تفاوت‌هایی دارد. این تفاوت ها تنها محدود به محدودیت در تصرفات مالکانه نمی</span><span lang="FA">‌</span><span lang="FA">شود.</span> <span lang="FA"> </span> <strong><span lang="FA">نتیجه: </span></strong><span lang="FA">در رابطه با قلمروی فضای محاذی رویکرد متحدالشکلی اتخاذ نشده است. لذا مشاهده می‌شود محدودیت های تصرفات نه تنها در حوزه ساخت و ساز، بلکه در حوزه استفاده از فضای محاذی نیز قابل توجه است. </span> https://journal.ihrci.ir/article_234351_0c656dbb86f51687a6867b066f3debb5.pdf
