This is especially true in the field of environmental issues. Soft rights have received increasing attention due to their flexibility and adaptability to conditions, the creation of conditions for broad government participation, and the reduction of their resistance to the implementation of directives. The mentioned features of soft law have caused it to have a high potential in international agreements and collective decisions, especially in the field of environmental issues.Conclusion: The Paris Convention on Climate Change has created a number of commitments for developed, developing and small countries, the main focus of which is the rapid reduction of greenhouse gas emissions, which is in line with the goals of reaching the desired temperature. The binding nature of the Convention's rules, the mixing of environment and security, the voluntary commitments of members based on the cooperation and coexistence of governments, the development of dispute resolution mechanisms are the most important examples of the moving from hard law to soft law in the Climate Change Convention.}, keywords = {Hard Law,Soft Law,International Law,Paris climate change convention,Enforcement Guarantee}, title_fa = {گذار از حقوق سخت به حقوق نرم در حقوق بین‌الملل با تأکید بر توافق‌نامه آب و هوایی پاریس}, abstract_fa = {زمینه و هدف: بحث گذار از مقررات سخت از جنبه‌های مغفول حقوق بین‌الملل است که در این مقاله تلاش شده با تأکید بر کنوانسیون تغییرات اقلیمی پاریس تبیین و تحلیل شود.مواد و روش‌ها: مقاله توصیفی تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی سؤال مورداشاره پرداخته است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: در حقوق بین‌الملل شاهد گذار از حقوق سخت به حقوق نرم هستیم. این به ویژه در زمینه مسائل زیست‌محیطی مصداق دارد. حقوق نرم به دلیل انعطاف و انطباق با شرایط، ایجاد شرایط مشارکت گسترده دولت‌ها و کاهش مقاومت آن‌ها در قبال اجرای دستورالعمل‌ها بیش از پیش موردتوجه روزافزون قرارگرفته است. ویژگی‌های مورداشاره حقوق نرم سبب شده، دارای پتانسیل بالایی در توافقات و تصمیمات جمعی بین‌المللی به ویژه در زمینه مسائل زیست‌محیطی داشته باشد.نتیجه‌گیری: کنوانسیون تغییرات اقلیمی پاریس تعهدات متعددی برای کشورهای پیشرفته، درحال‌توسعه و کوچک در راستای کاهش انتشار گازهای گلخانه‌ای تعریف کرده است که در چارچوب حقوق نرم قابل تبیین است. فقدان ضمانت اجرای الزام‌آور آن گونه که در حقوق سخت مطرح است و تعهدات داوطلبانه اعضاء مبتنی بر همکاری و همزیستی دولت‌ها و تدوین مکانیسم حل و فصل اختلافات مبتنی بر سازش و همکاری مهمترین مصادیق و جنبه‌های گذار از حقوق سخت به حقوق نرم در کنوانسیون تغییرت اقلیمی پاریس است.}, keywords_fa = {حقوق سخت,حقوق نرم,حقوق بین‌الملل,کنوانسیون تغییرات اقلیمی پاریس,ضمانت اجرا}, url = {https://journal.ihrci.ir/article_148631.html}, eprint = {https://journal.ihrci.ir/article_148631_31dea0642aca959117fe9e153d7cf9cc.pdf} }
