In addition, using the research method of multi-stage ijtihad and the opinion of Islamic financial experts and great authorities of imitation, the conditions of the license to use cryptocurrencies have been calculated.Findings: The findings of the present study show that there is disagreement among jurists about the legitimacy of this money. Some jurists consider its illegitimacy and the most important reasons for jurists to reject the legitimacy of Bitcoin is the ambiguity of this currency, the uncertainty of its origin and destination, its high risk and its foreignness. But some other jurists and economists believe in the legitimacy of virtual currency and give reasons for its legitimacy.Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: The view of jurisprudence is affirmative in the face of emerging financial issues such as bitcoin. Money approved by Shiite jurisprudence is not confined to cash. The tax of a currency has a direct relationship with its desirability among the common sense and the people. In Shiite jurisprudence, there is no evidence that the tax created is a benefit of consumerism, and virtual currency and bitcoin are taxed.}, keywords = {jurisprudential rulings,Cryptocurrency,bitcoin,Virtual Currency,legitimacy,illegitimacy}, title_fa = {بررسی احکام فقهی ارز مجازی: مطالعه موردی بیت کوین}, abstract_fa = {چکیده:زمینه و هدف: بیت کوین، (ارز مجازی) پول رمزنگاری شده‌ای است که فقط از راه فضای مجازی مورد استفاده قرار می‌گیرد. در پژوهش حاضر ابعاد فقهی موضوع با دو رویکرد فقه فردی و حکومتی و همچنین در دو سطح معامله و استخراج تبیین گشته است؛ علاوه بر این نیز با استفاده از روش تحقیق اجتهاد چندمرحله ای و نظر خبرگان مالی اسلامی و مراجع عظام تقلید شروط جواز استفاده از پول‌های رمزنگاری شده احصا گردیده است.یافته‌ها: یافته‌های پژوهش حاضر نشان می‌دهد که، در خصوص مشروعیت این پول بین فقها اختلاف نظر است، بعضی فقها نظر به عدم مشروعیت آن دارند و مهمترین دلایل فقهاء برای رد مشروعیت بیت کوین ابهام داشتن این ارز، مشخص نبودن مبدا و مقصد آن، پرخطر و ریسک‌پذیر بودن و خارجی بودن آن است. اما برخی دیگر از فقها و اقتصاددانان قائل به مشروعیت ارز مجازی هستند و دلایلی نیز بر مشروعیت آن بیان می‌دارند.نتیجه‌گیری: دیدگاه فقه در مقابل با موارد مستحدثه مالی از جمله «بیت کوین»، تأییدی است. پول مورد تأیید فقه شیعه محصور به وجوه نقد نیست. مالیت یک ارز رابطه مستقیمی با مطلوبیت آن در میان عرف عقلاء و مردم دارد. در فقه شیعه هیچ قید و مبنایی مبنی بر آن که مالیت ایجاد شده از مزایای مصرف‌گرایی باشد وجود ندارد و ارز مجازی و بیت‌کوین مالیت دارد.واژگان کلیدی: احکام فقهی، پول رمزنگاری شده، بیت کوین، ارزمجازی، مشروعیت، عدم مشروعیت}, keywords_fa = {احکام فقهی,پول رمزنگاری شده,بیت کوین,ارزمجازی,مشروعیت,عدم مشروعیت}, url = {https://journal.ihrci.ir/article_144972.html}, eprint = {https://journal.ihrci.ir/article_144972_03c2a0fa0313019c0e8063d1fcadc312.pdf} }
